James Faleke asks Court to declare him the governor-elect of Kogi State

Faleke the All Progressives Congress deputy governorship candidate in the November 21 election in Kogi State on Tuesday filed a suit at the Federal High Court, Abuja, asking the Court to declare him governor-elect.

This appeal cam from him came on the heel of The Independent National Electoral Commission after declaration of the election inconclusive for difference in vote cast figure margin which necessitated INEC to order for supplementary election on 5th December.

On Monday, Mr. James vowed that he will go to court to challenge the adoption of Yahaya Bello The All Progressive Congress (APC) National Leadership took the position on their governorship candidate for the party in the supplementary election slated to hold December 5.

In the same vein, Faleke wrote to INEC compelling the it to remove his own name as the running mate to Yahaya Bello in the supplementary election.

You will recall that the death of APC former governorship candidate for November 22, Prince Abubakar Audu. necessitated the adoption of Mr. Yahaya Bello at the meeting of the National Working Committee of the party.

When that happened, APC immediately forwarded the name of Yahaya Bello to INEC as replacement for Mr. Abubakar Audu with that of Mr. James Faleke as his running mate in the supplementary election .

Counsel to Mr James, Wole Olanipekun, said contrary to the claim made by the electoral body that Mr Bello is the right candidate by law, the election was conclusive already based on the figures and facts on ground. Hence, as the running mate to Mr. Abubakar Audu, he automatically fits into the position of his late Boss, and should be declared winner and sworn inn as the Governor of Kogi state. For record purposes, Mr. James Faleke, is a serving member of the House of Representatives, in Kogi state.

Mr James said the court papers were served on INEC Tuesday afternoon.

He prayed the INEC not to go ahead with the proposed supplementary election December 5.

Mr. Olanipekun, whom James Faleke wrote through read thus:

In law and logic, no new candidate can inherit or be a beneficiary of the votes already cast, counted and declared by INEC before that candidate was nominated and purportedly sponsored,” Mr. Faleke wrote through

Assuming without conceding that INEC is even right to order a supplementary election, the votes already cast, counted and declared on Saturday, 25th November 2015, were votes for the joint constitutional ticket of Prince Abubakar Audu and our client.

Therefore, no new or supplementary candidate can hijack, aggregate, appropriate or inherit the said votes.

Faleke also wrote another letter to APC Chairman, John Oyegun, urging his party to distance itself from what he called Greek Gift offered to it to nominate a new candidate for planned supplementary election in 91 polling units which Mr Bello lost to People Democratic Party (PDP) right under his nose.

Faleke affirmed that the election had already been won and lost. He said that what the party needs now is to rather support him in actualizing the mandate already given to APC and its candidates in the just concluded election by figures and facts, and in disguise.

If we recall, with the result declared by INEC, Mr. Abubakar Audu had the highest number of votes , leading the 21 other candidates, which includes Idris Wada, the incumbent governor of Kogi State, the flagbearer of the Peoples Democratic Party (PDP).
